Terms of Use

These Terms of Use ("Terms") govern your use of Tend, a maintenance-inbox service provided by NYRAI LLC ("we," "us," "Tend"). By creating an account, submitting a maintenance report, or otherwise using the service, you agree to these Terms. If you do not agree, do not use Tend.

Tend is not an emergency service. Tend helps route maintenance requests to landlords. It is not monitored around the clock and is not a substitute for emergency services. If there is a fire, gas leak, flooding, medical emergency, or any immediate threat to safety, call 911 (or your local emergency number) and your landlord directly. Do not rely on Tend to summon emergency help.

1. The service

Tend lets landlords receive, organize, and track maintenance reports submitted by their tenants, including photos and automatically generated summaries and severity rankings. Tenants can submit reports through a landlord's share link without an account.

2. Accounts

Landlords are responsible for the accuracy of their account information, for keeping their credentials secure, and for all activity under their account. You must be at least 18 years old and able to form a binding contract to hold an account.

3. Acceptable use

Use Tend only for legitimate property-maintenance purposes.
Do not submit unlawful, harassing, or deliberately false reports, or content you do not have the right to share.
Do not attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the service.
Landlords are responsible for how they share their property links and for responding appropriately to reports they receive.

4. Tenant submissions

Reports submitted through a landlord's share link are delivered to and stored on behalf of that landlord. By submitting a report, a tenant authorizes us to process it and provide it to the associated landlord. Please submit only information you are comfortable sharing with your landlord.

5. Automated triage

Tend uses automated tools to summarize reports and estimate severity. These are aids, not guarantees. Landlords remain responsible for reviewing reports and exercising their own judgment about how urgently to respond. We do not warrant that any severity ranking is accurate or complete.

6. Subscriptions and billing

Paid plans are billed on a recurring basis as described at sign-up (a flat monthly rate, with a free trial where offered). You may cancel at any time; cancellation stops future charges and takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. Where the service is purchased through the Apple App Store, billing, renewals, and cancellations are handled by Apple under its terms.

7. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that reports will be delivered without delay.

8. Limitation of liability

To the maximum extent permitted by law, NYRAI LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any property damage, injury, or loss arising from a maintenance issue, delayed repair, missed report, or reliance on the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

9. Termination

We may suspend or terminate access for violation of these Terms or to protect the service. You may stop using Tend and close your account at any time.

10. Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules.
